LAMINATES STANDARD PRODUCT LIMITED WARRANTY

1. Scope: This Product Limited Warranty shall only apply to buyers of EDL Pte Ltd’s (“EDL”) Products.

2. Limited Warranty:

• EDL warrants to a buyer to which EDL has sold a Product (the “Buyer”), for a period of one (1) year after the date of purchase of the Products by the Buyer, that the Products conform to the specifications sheets, available upon request by the Buyer, with only reasonable deviations to the same. Only the Product Limited Warranty in force at the date of the initial shipment / delivery of the Products to the Buyer shall be applicable and effective.

• EDL’s liability shall be limited to the replacement of defective Product(s) or reimbursement of the costs of such Product(s) only.

3. Limited Warranty Conditions: This Product Limited Warranty shall be null and void and/or shall be deemed to be revoked upon any failure to fully adhere to any of the following conditions:

• The Buyer has paid the price for the Products in full and has complied with all its payment obligations under the Agreement with EDL;

• The Products have been duly installed in accordance with all applicable codes, standards, laws and regulations;

• The Products have been used and maintained in accordance with EDL’s Care & Maintenance Guide which can be accessed at edleuro.com which may be revised from time-to-time at EDL’s sole discretion.

• Upon delivery of the Products to the Buyer or collection of the Products by the Buyer (as the case may be), the Buyer shall have promptly inspected the Products to determine the presence of any defects that are apparent, or should have been apparent, to the Buyer by way of a visual inspection, and the Buyer shall have notified EDL of any such defects within three (3) working days of the date of delivery of the Products to the Buyer.

• The Products shall not have been modified or altered following delivery of the same to the Buyer or collection of the same by the Buyer except as may be necessary for proper processing meeting all applicable codes and standards.

• For the purposes of making a claim under this Product Limited Warranty, for anything other than a patent defect as described under Clause 3(a)(iv) above, the Buyer shall have notified EDL in writing of any alleged defect within thirty (30) days of the date that the Buyer discovered or should have reasonably discovered such defect, and submitted the claim to EDL accompanied by this limited warranty, and with evidence that the Product(s) were purchased by the Buyer directly from EDL.

4. Remedy: In the event that the Products fail to conform to this Product Limited Warranty, EDL shall, at its sole option and discretion, either repair the defective Product(s), refund to the Buyer the costs they paid (up to the invoice value) or furnish replacement product(s) limited to the same value of the Product(s). The period of limited warranty applicable to a repaired or replaced Product shall be the remainder of the unexpired period of this Product Limited Warranty. If EDL chooses to repair the defective Product(s), EDL must be allowed to make the repair. If EDL chooses to supply new Product(s), EDL shall only be obliged to supply Product(s) which match the colour of the Products originally supplied as closely as possible and is not obliged to supply an identical colour.

5. Limitations of Damages; Exclusive Remedy: The repair, reimbursement or replacement of defective Product(s) shall be the sole and exclusive remedy hereunder. Except to the extent prohibited by applicable law, EDL shall not be liable for any incidental or consequential damages (including but not limited to dismounting costs, reinstallation costs and/or access equipment costs) or for breach of any other warranty, express or implied, EDL is not liable for indirect losses (including but not limited to loss of profits, loss of use, operating losses), losses incurred by third parties, or losses to the extent covered by any insurance taken out by the Buyer.

 6. Exclusions: This Product Limited Warranty does not cover any defect in any materials or components other than the Product(s), damages attributed to causes unrelated to the Product manufacturing process, including but not limited to:

• incorrect, faulty or improper transportation, storage and handling of the Product(s),
• improper installation of the Product(s) including unauthorised alteration to the same,
• misuse or improper or unintended usage of the Product(s),
• lack of or improper maintenance of the Product(s)
• the use of harmful cleaning compounds;
• damages caused by or resulting from the combination or assembly of any such other materials or components with the Product(s),
• general fading or discolouration or damage due to direct and indirect light (exposure to direct sunlight / UV rays) should be avoided,
• improper or unintended usage of the Products,
• outdoor usage,
• normal weathering,
• exposure and/or damage due to mould and/or mildew,
• exposure to corrosive elements in the atmosphere,
• exposure to extreme temperatures,
• normal wear and tear,
• impact,
• unreasonable use,
• physical abuse,
• accidental damage,
• faulty workmanship by any person other than the Seller,
• variation in colours arising out of materials being produced in different batches,
• variation in colour, pattern, shade of material against the sample material, display(s) and/or printed illustrations.
• differences found between digital samples or photographs of the Products viewed on EDL’s website and the actual installed Product. Actual colours may vary from the colours viewed on EDL’s website due to typical monitor colour restrictions.
• appearance variations within acceptable tolerances. For the avoidance of doubt, the variations are within acceptable tolerances unless:
  1. there is one foreign substance larger than 0.6mm² which can be seen without assistance of any equipment from a distance of 2m away; or
  2. there are two or more foreign substances larger than 0.3mm² within a diameter of 300mm and can be seen without assistance of any equipment from a distance of 2m away.
• force majeure, whatsoever.
